MORTGAGE
FORECLOSURE SALE

Default having been made in the payment of that certain Note and in the terms of that certain Mortgage executed by Crystal Braden and John Braden, wife and husband, to Mortgage Electronic Registration Systems, Inc. (“MERS”), (solely as nominee for Lender, New South Federal Savings Bank, and Lender’s successors and assigns), dated the 16th day of December, 2005, which Mortgage was recorded in the Office of the Judge of Probate of Butler County, Alabama, in Real Property Book 419, at Page 729; said Mortgage having subsequently been transferred and assigned to Alabama Housing Finance Authority. The undersigned, Alabama Housing Finance Authority, as Assignee of said Mortgage will, under and by virtue of the power of sale contained in said Mortgage, sell at auction to the highest bidder for cash before the main entrance of the Butler County Courthouse in the City of Greenville, Alabama, during the legal hours of sale on March 8, 2012, the real property described in said Mortgage, which said description is hereby referred to and made a part hereof, said property being situated in Butler County, Alabama, to-wit:

Begin at the point of intersection of the East right of way line of Butler County Highway No. 25 (Reddock Springs Road) with the South right of way line of Butler County Highway No. 30 (Wald Road); run thence East along the South right of way line of said Wald Road 185 feet to a point, run thence in a southerly direction 217 feet to a point, run thence in a westerly direction 220 feet to a point on the East right of way line of said Reddock Springs Road, run thence in a northerly direction along said East right of way line of said Reddock Springs Road 217 feet to the point of beginning; situated, lying and being in the North Half of the Southwest Quarter of the Northwest Quarter of Section Eleven, Township Nine, Range Thirteen, Butler County, Alabama.

This sale is made for the purpose of realizing the mortgage debt, together with all expenses of the sale, including a reasonable attorney's fee.

SEALED BIDS WILL BE RECEIVED BY THE COUNTY COMMISSION OF BUTLER COUNTY, ALABAMA AT 202 PATSALAGIA ST, GREENVILLE, ALABAMA, UNTIL 10:00 A.M., FEBRUARY 9, 2012, AND AT THAT TIME PUBLICLY OPENED FOR CONSTRUCTING THE FOLLOWING:

CONSTRUCTION OF AN ABOVE GROUND FUEL FACILITY

THE BRACKET ESTIMATE ON THIS PROJECT IS FROM $40,000 TO $70,000. THIS BRACKET RANGE IS PROVIDED ONLY AS A GENERAL INDICATION OF A BROAD FINANCIAL SIZE CATEGORY FOR THE PROJECT. IT SHOULD NOT BE USED IN PREPARING A BID, NOR WILL IT HAVE ANY BEARING ON ANY DECISION TO AWARD THE CONTRACT. THE PRINCIPAL ITEMS OF WORK ARE APPROXIMATELY AS FOLLOWS:

INSTALLING TWO NEW FUEL STORAGE TANKS, TWO FUEL PUMPS AND FUEL CONTROLLED SYSTEM

THE ENTIRE PROJECT SHALL BE COMPLETED IN 60 CALENDAR DAYS.

A CASHIER’S CHECK (DRAWN ON AN ALABAMA BANK) OR BID BOND FOR 5% OF THE AMOUNT BID (MAXIMUM OF $10,000.00) AND MADE PAYABLE TO THE BUTLER COUNTY COMMISSION MUST ACCOMPANY EACH BID AS EVIDENCE OF GOOD FAITH. IN ACCORDANCE WITH STATE LAW, ALL OWNERS, ARCHITECTS, AND/OR ENGINEERS RECEIVING BIDS ON THIS PROJECT MUST REQUIRE BIDDERS TO INCLUDE THEIR STATE CONTRACTOR’S LICENSE NUMBER ON THEIR BID PROPOSAL. CONTRACTORS MUST PROVIDE PROPER PROOF OF ALL APPLICABLE LICENSURES BEFORE THEIR BIDS CAN BE CONSIDERED. PROOF OF INSURANCE COVERAGES OF THE TYPES AND AMOUNTS AS SET FORTH IN THE PROJECT SPECIFICATIONS WILL BE REQUIRED OF THE CONTRACTOR, AND ANY AND ALL SUBCONTRACTORS, PRIOR TO BEGINNING WORK. THE CONTRACTOR WILL BE REQUIRED TO PERFORM WORK AMOUNTING TO AT LEAST 30% OF THE TOTAL CONTRACT COST WITH HIS OWN ORGANIZATION.

THE SUCCESSFUL BIDDER WILL BE REQUIRED TO PROVIDE WRITTEN CERTIFICATION THEY ARE IN COMPLIANCE WITH SECTION 9 OF THE STATE OF ALABAMA IMMIGRATION LAW (ACT 2011-535) BY SUBMITTING 1) THE AFFIDAVIT FOR BUSINESS ENTITY/EMPLOYER/CONTRACTOR AND, 2) SUCCESSFUL BIDDER’S ONE-PAGE E-VERIFY COMPANY PROFILE DOCUMENT (SEE EXAMPLE INCLUDED). THE TWO REQUIRED DOCUMENTS MUST BE SUBMITTED PRIOR TO ISSUANCE OF A CONTRACT OR PURCHASE ORDER. TO EXPEDITE THE ORDERING PROCESS, FORMS MAY BE SUBMITTED WITH THE BID RESPONSE.

TO BE ELIGIBLE FOR CONSIDERATION, BIDS MUST BE SUBMITTED ON COMPLETE ORIGINAL PROPOSALS MADE AVAILABLE BY THE OWNER.
