NUMBER 1378
AN ORDINANCE AMENDING SECTION 82-5, CODE OF ORDINANCES OF THE CITY OF HARTSELLE, ALABAMA, SO AS TO REQUIRE PERMITS FOR PARADES, PROCESSIONS, ASSEMBLIES, EVENTS AND DEMONSTRATIONS IN OR UPON THE PUBLIC STREETS AND WAYS IN THE CITY OF HARTSELLE, ALABAMA; DECLARING IT A MISDEMEANOR TO VIOLATE THE PROVISIONS HEREOF; AND PROVIDING PUNISHMENT FOR VIOLATION
WHEREAS, the existing ordinances of the City of Hartselle, Alabama do not address permits for public events other than parades, processions, assemblies or demonstrations; and
WHEREAS, it has come to the Council's attention that there is need for some provision for planning, safety and public convenience considerations and order in public events other than parades, processions, assemblies and demonstrations.
NOW, THEREFORE, be it ORDAINED by the City Council of the City of Hartselle, Alabama, as follows, to-wit:
Section 1. Section 82-5, Code of Ordinances of the City of Hartselle, Alabama is hereby amended by deletion of the entire language of said section and substitution of the following so that hereafter said Section 82-5 shall read, in its entirety, as follows:
"(a) Permit Required
It shall be unlawful to promote, organize, hold or to assist in promoting, organizing or holding, or to take part or participate in any parade, procession, assembly, event or demonstration
(i) in the streets, highways or public ways and places of the City of Hartselle, Alabama, ("City"); or
(ii) upon private property in the City where the parade, procession, assembly, event or demonstration is likely to produce noise in violation of applicable City ordinances or this Code or to produce congestion of the public streets, ways or places to the extent that it will likely cause public inconvenience or hazards to public safety, unless a permit for such purposes has been first secured
from the City as hereafter provided.
(b) Application for Permit
Before a permit for the purposes specified in Section (a) hereof can be secured, a written application in such form as the City may require for the permit shall be submitted to the City Clerk setting forth the following:
(i) the date(s), time(s) and expected duration(s); and
(ii) the probable number of persons, vehicles and animals which may be involved;
and
(iii) the purpose for which the parade, procession, assembly, event or demonstration is to be held; and
(iv) the street(s), highway(s), public way(s) or public place(s) where the parade, procession, assembly, event or demonstration is proposed to be held or over which passage is desired or which may be affected and
(v) such other information as the City Clerk, of her own initiative or upon advice of the Fire Chief or Police Chief may require.
(c) Issuance of Permit, Terms and Conditions
A permit for such parade, procession, assembly, event or demonstration prescribing the street(s), highway(s), or public place(s) which may be used or affected by the applicant, together with the date(s) and time(s) and anticipated duration of such use and any other conditions deemed appropriate by the Council shall be issued unless in the judgment of the Council, the public welfare, safety, peace, health, good order or convenience require that the permit be denied. In the event any such parade, procession, assembly, event or demonstration is proposed to be of an enduring or indefinite time, the Council may require that the permit be renewed from time to time.
(d) Violation; Punishment
It shall be unlawful and a misdemeanor, punishable upon conviction by a fine not to exceed five hundred dollars ($500.00) or by a jail sentence not to exceed six (6) months, or by both such fine and jail sentence, for any person, firm, corporation or other entity to violate any provision of this Section or to exceed or violate the scope, terms or conditions of any permit issued pursuant to this Section, any rules or regulations furnished to the applicant by the City or any order revoking the permit. Each day upon which such a violation occurs shall constitute a separate offense.
(e) The City shall have the right to revoke any permit upon violation of the conditions of the permit or the provisions of this Section.
(f) Exemptions
(i) There shall be no such permit required for a bona fide funeral procession.
(ii) There shall be no such permit required for parades, processions, assemblies or events conducted by the City or any of its departments.
(g) Obedience to Other Laws
Unless specifically stated to the contrary in the permit all other ordinances or Code provisions generally applicable to the conduct of persons or operation of vehicles in the City shall continue in force and shall be observed by all parties involved with, taking part in or observing the parade, processions, assembly, demonstration or event authorized by the permit granted pursuant to this Section."
Section 2. Effective Date
This Ordinance shall be effective immediately upon its adoption and publication according to law.
