NOTICE TO CREDITORS
WHEREAS, on the 23rd day of October, 2009, Letters of Administration in the estate of LaVerta Joyce Beard Bryant, deceased, were granted and issued to the undersigned as Administrator by the Chancery Court of Adams County, Mississippi, in Cause No. 2009-642:
NOW, THEREFORE, all persons having claims against the estate of said decedent are hereby notified and required to have the same probated, registered and allowed by the Clerk of the Chancery Court of Adams County, Mississippi, within ninety (90) days after the date of the first publication of this notice, and all claims not so probated, registered and allowed within ninety (90) days will be forever barred.

Sealed bids will be received by the City of Natchez, Office of the City Clerk, 124 South Pearl Street, Natchez, Mississippi for the American Recovery and Reinvestment Act (ARRA) Cold Milling and Overlay Project, until no later than 5:00 p.m., Local Time, December 22, 2009 and shortly thereafter publicly opened and read allowed.
The work shall consist essentially of the following items:
The majority of work being milling and overlay operations including ADA ramps at various locations in the downtown Natchez area. All other related items of work required to complete the project are shown and specified in the Contract Documents and Project Plans. Federal Project No. STP-0340-00(034) LPA, City Project No. 023-09-FAU/ARRA.
The attention of bidders is directed to the Contract Provisions governing selection and employment of labor. Minimum wage rates have been predetermined by the Secretary of Labor and are subject to Public Law 87-58 1, Work Hours Act of 1962, as set forth in the Contract Provisions.
The City of Natchez hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, sex, religion or national origin in consideration for an award.
The award of this contract will be contingent upon the Contractor satisfying the DBE requirements.
Plans, specifications, and contract documents may be examined without charge in the office of David Gardner, Natchez City Engineer, 150 B North Shields Lane, Natchez, Mississippi 39120, or obtained from said office for a charge of $50.00, not refundable, which partially covers the cost of reproduction and handling.
Plans will be shipped upon receipt of payment.
Bid bond, signed or countersigned by a Mississippi Resident Agent, with Power of Attorney attached or on file with the City, a Cashier's check or Certified Check for five (5%) percent of bid, payable to CITY OF NATCHEZ, MISSISSIPPI, must accompany each proposal.
No bid may be altered, modified or withdrawn within sixty (60) days after being filed with the Board. The Board of Aldermen reserves the right to reject any and all bids, to waive any formalities, to negotiate with the lowest and best bidder to reduce the bid price to come within the funds allocated for the work, to reduce the job in order to stay within available funding or as desirable in the discretion of the Board of Aldermen, and to accept bids by classes and/or groups, if applicable, all as set forth and in accordance with applicable Mississippi law and in the Instructions to Bidders.

SUBSTITUTED TRUSTEE'S NOTICE OF SALE
WHEREAS, on December 5, 2000, Tywanna F. Barnes, a married person and Kevin Barnes, her husband, executed a certain deed of trust to First American Title, Trustee for the benefit of Cendant Mortgage Corporation which deed of trust is of record in the office of the Chancery Clerk of Adams County, State of Mississippi in Book 609 at Page 78, as modified in Book 711 at Page 545 and modified in Book776 at Page 256; and
WHEREAS, said Deed of Trust was subsequently assigned to MidFirst Bank by instrument dated May 12, 2003 and recorded in Book 668 at Page 665 of the aforesaid Chancery Clerk's office; and
WHEREAS, MidFirst Bank has heretofore substituted J. Gary Massey as Trustee by instrument dated November 18, 2003 and recorded in the aforesaid Chancery Clerk's Office in Book 680 at Page 613; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, MidFirst Bank, the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust and for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expense of sale.
NOW, THEREFORE, I, J. Gary Massey, Substituted Trustee in said deed of trust, will on December 11, 2009 offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the Westerly Front Door of the County Courthouse of Adams County, located at Natchez, Mississippi, to the highest and best bidder for cash the following described property situated in Adams County, State of Mississippi, to-wit:
Lot Twenty-Eight (28), Highland Oaks Subdivision as shown on map or plat entitled "Addition to Highland Oaks Subdivision being portion of R. Lee Parker Mt. Airy Plantation & Highland Plantation T6N-R2W" a subdivision according to a map or plat thereof which is on file of record in the office of the Chancery Clerk of Adams County, MS, in Plat Book 8, Page 6, reference to which is hereby made in aid of and as a part of this description.
